NEW YORK — Manhattan prosecutors on Thursday dropped the remaining rape charge against Harvey Weinstein, avoiding a fourth trial in New York after the accuser said she could not endure testifying again.
The Manhattan District Attorney’s Office moved to dismiss the third-degree rape charge involving Jessica Mann, an aspiring actress and hairstylist. A judge formally dismissed the charge the same day.
The charge stemmed from allegations of an incident in 2013. It had remained unresolved after Weinstein’s 2020 conviction on related sex crime charges was overturned by New York’s highest court in 2024. Subsequent retrials in 2025 and earlier in 2026 ended in hung juries and mistrials.
Manhattan District Attorney Alvin Bragg said in a statement that Mann had testified before two grand juries and three trial juries, describing it as an “extraordinarily taxing ordeal.”
“To be clear, we believe Ms. Mann’s account and her credibility as a witness,” Bragg stated.
Weinstein, 74, remains incarcerated. He continues to serve a sentence from a separate New York conviction on another sexual felony charge and holds convictions in California.
Mann’s decision followed the most recent mistrial declared in May 2026 after a jury deadlocked. Prosecutors had indicated they would not pursue the matter further if she declined to participate in another trial.
Weinstein’s legal team welcomed the dismissal. Defense attorneys had argued that repeated proceedings placed an unfair burden on their client.
The development concludes the New York prosecution related to Mann’s allegations, part of the broader #MeToo cases that emerged against Weinstein beginning in 2017. The former film producer was once a powerful Hollywood executive.
As of Thursday, no further trials were scheduled in New York on this matter. Weinstein’s representatives and the district attorney’s office had no additional immediate comments on potential appeals or other legal steps.
